This application is for the installation of a new PVC fence along their rear and side property lines. Applicant provided a proposal from Family Fence company along with a survey dated 2/6/2023 prepared by A. Agujo Surveying, Inc.
Section 470-30 C. (1) states “Constructed fences shall not exceed a height of more than four feet, with the exception of an open-wire constructed fence of an approved type, which shall not exceed six feet in height”.
Applicant will also need to show compliance with the balance of the Chapter.
 A variance application will be required from the Zoning Board of Appeals.

On September 21, 2020 the Board of Appeals granted an extension of variances for the construction of a 3 story and basement mixed use commercial building comprised of retail at the basement and first level and offices on the second and third level.
            On October 20, 2020 the Board of Trustees approved the special use permit pursuant to Sec 470-13 and 470-53 for the above mentioned uses.
 

            The applicant has submitted a revised application to the Village requesting the conversion of the granted uses to a mixed-use residential building comprised of a 2-bedroom residential unit at the basement level; a retail use at the first level (no change) and a 2-bedroom residential unit at the second level and a 1-bedroom residential unit at the third level. They have not submitted any requests to alter the exterior or floor area of the prior approved building.         Previous Board approvals have since expired which has prompted the Applicant to return in order to receive current approvals.

            Proposed Program:

            First Floor                       Retail Use – 1,257 gsf
            Second Level             (1) 2-Bedroom residential unit (1,493 gsf +/-)

 The total gross buildable area is 5,178.5 sf (no change).

The applicant is requesting to convert and expand the existing restaurant building into a mixed-use building with residential units and retail space.Section 470-18.B.(2)(a) permits a gross density no greater than 12 residential units per acre. The existing lot is comprised of .279 acres allowing an as-of-right density of 3.35 residential units.The Applicant is proposing a total of 6 residential units. Further, Section 470-18.B.(2) permits residential units above the first floor level in conjunction with ground floor retail or office use.The applicant is proposing residential units below, on the same level and above the retail use.
